General Terms and Conditions

  1. General

The General Terms and Conditions are compiled in accordance with the regulations in the field of protection consumers, based on the recommendations of the Chamber of Commerce of Slovenia and international codes for online and electronic commerce. With the online shop Smalti Rogaška (hereinafter referred to as the “online shop”) is managed by I.C. MONT d.o.o., Brestovška cesta 16, 3250 Rogaška Slatina, Slovenia (VAT no .: SI55345468) service provider electronic commerce (hereinafter referred to as the “Merchant”).

By registering in the online shop, the visitor obtains a username that is the same as his e-mail address and the user password specified by the user alone. The username and password of the user are unambiguously identified and linked to entered data. By registering, the visitor confirms and guarantees that he / she is of legal age, a fully capable person. By registering, the visitor becomes a user and acquires the right to purchase. By purchasing a product, the user becomes a customer.

These general terms and conditions define the operation of the online shop, rights and the duties of the visitor, user and customer and the business relationship between the Merchant and users as buyers of products from the online shop offer.

  1. Availability of information

The Merchant undertakes to always have available to the user:

  • information on the identity of the Merchant (especially the company name and registered office of the company and the number the register where the company is registered);
  • contact information that allows the user to communicate quickly and efficiently with the Merchant (email address, phone number, etc.);
  • information on the essential characteristics of the products or services from the online shop offer, including after-sales services and warranties;
  • information on product availability or services provided from the online shop;
  • method and conditions of delivery of products or execution of services, in particular place and time delivery;
  • information of the method of payment;
  • data on the time validity of the offer from the online shop;
  • information on the period during which it is still possible to withdraw from the contract and the conditions for resignation;
  • information on the possibility of returning products and how much such a return costs the user;
  • information on the user complaint procedure and information of contact person from the Merchant for customer relations
  1. Product offer, delivery time and acceptance

The supply of products in the online shop due to the nature of online business quickly changes and updates.

Delivery time for products in stock is up to 7 working days. For other products that are not in stock, contact us at info@smaltirogaska.com. If a customer decides to buy two products, he must always consider them the delivery time of the product that is the longest.

If the product on offer is no longer available or the delivery time is longer than we will notify you by email.

The customer receives the package via the delivery service of DHL. Personal collection packages is possible, but only by prior arrangement.

  1. Methods of payment

The merchant provides the user with the following methods of payment for the purchase of products from the Internet shops:

  • by PayPal;
  • By credit card
  1. Prices

The online price is valid for all users of the Merchant’s online shop.

All prices in the online shop are in euros. All prices in the online shop are prices of the products and do not include delivery costs (see point 10). All prices are valid only for electronic ordering of products through the online shop.

All prices are valid at the time of placing the order and have no pre-determined validity, therefore, they are valid only until their respective change. Despite the extraordinary efforts from the Merchant to provide the most up-to-date and accurate information it may happen that the provided prices to be wrong. In the case of the previous sentence and in the case where the price of the product changes during the processing of the order, ie from the moment of placing the order until confirmation orders, the Merchant will:

  • inform the user (buyer) and inform him of the new prices, the user (buyer) in such a case has the possibility to change his order either in part or cancel completely or confirm the order at the new prices, all without additional costs; or
  • enable the user (buyer) to withdraw from the purchase and at the same time offer him a solution that will go to mutual benefit and satisfaction.
  1. Purchase process

6.1. Technical steps leading to the conclusion of a sales contract

The following technical steps are available to the user (buyer) in the purchase process:

  • login to the online shop using an email address or username passwords if the user (customer) has previously created a user account (see also point 1);
  • search for an individual product in the offer of products in the online shop;
  • product selection to purchase;
  • adding the selected product for purchase to the shopping cart;
  • determining the quantity of the product to be purchased in the shopping cart;
  • review of the price of the selected product in the selected quantity, including the invoiced tax, if may apply;
  • selection of the method of delivery of the product (see also points 3 and 10);
  • choice of payment method (see also point 4);
  • review of the order with the selected method of product delivery and charged costs of delivery, and
  • confirmation and award of the contract and thus the completion of the purchase (see also points 6.3 and 6.4.).

6.2. Technological means to identify and correct errors before placing an order

Before placing an order, it is to the user (customer) via a graphical user interface enabled to, with immediate effect, easily and without difficulty:

  • sees and reviews which products he has selected and added to the shopping cart;
  • sees and reviews the price of an individual product and the total price of the entire selected one quantities of each product;
  • changes the selected quantity of an individual product and calculates the new price as follows modified quantities;
  • removes selected products that it does not want to buy.

Before confirming the order, it is to the user (customer) via a graphical user interface to with immediate effect, easily and without problems:

  • changes the chosen method of product delivery;
  • changes the chosen method of payment and
  • reviews and approves individual changes.

6.3. Order accepted

After placing the order, the user (buyer) receives from the Merchant an e-mail notification that the order has been accepted. Within 1 hour of receiving this notice the user (buyer) has the option to cancel the order free of charge. The user (buyer) in his profile on the Merchant ‘s website always has comprehensive status information and the content of each order.

6.4. Order confirmed

If the user (buyer) does not cancel the order, the order goes into further processing. Merchant reviews the order upon receiving, checks the availability of ordered products and confirms the order or rejects with reason. The Merchant can contact the user (buyer) via phone number given at the login to verify the data or ensure punctual delivery. Upon order confirmation, the Merchant informs the User (buyer) by e-mail about the estimated delivery time. The purchase contract at this stage for the purchase of ordered products between the user (buyer) and the Merchant is irrevocably concluded (see point 7).

6.5. Order shipped

The Merchant prepares and sends the ordered products within the agreed deadline and informs the user (buyer) by e-mail. In an email from the previous sentence the Merchant also informs the user (buyer) about the product return policy and informs him with contact persons in case of complaint or delay in delivery.

  1. Purchase contract

The merchant issues a written invoice to the user who buys the product from the online shop, with broken down costs. The sales contract in the form of a purchase order is in electronic form stored on the Merchant ‘s server and is accessible to the user (buyer) in at any time in his user profile. The sales contract is concluded in the English language.

The purchase contract between the Merchant and the user (buyer) is concluded in the moment the Merchant confirms the order (see point 6.2.). From that moment on, all prices and other conditions of purchase are agreed and apply to both the Merchant and the user (buyer).

  1. Right of withdrawal, return of products

The user (buyer) has the right to within 14 days from the date of receipt of the ordered products to inform the Merchant on e – mail address info@smaltirogaska.com that it is withdrawing from the sales contract with a reason of withdrawal. Return of purchased products to the Merchant within the period for withdrawal from the sales contract is considered a message about resignation. The only cost incurred due to withdrawal from the sales contract user (buyer), is the cost of returning the products to the Merchant.

Purchased products must be returned to the Merchant no later than 30 days from the date of the submitted notice of withdrawal from the sales contract. The purchased products must be returned to the Merchant undamaged, in the original packaging and unaltered quantity, unless the products are destroyed, damaged, lost or their quantity has been reduced without the user (buyer) being at fault. If the package of the received ordered products is physically damaged or if it is missing content or if it shows signs of opening, the user (buyer) must initiate the procedure Complaints to the DHL delivery service (see item 15).

For returned products the Merchant will refund the purchase price (not including shipping) in 14 day of receiving the returned products or as soon as possible. Gift voucher, any used promotional codes and other discounts are given to the user (to the buyer) are not returned. The refund of the paid amount is made by the Merchant on a personal or transaction account of the user (buyer). The used gift voucher is returned by the Merchant in the form credits.

Sample boards, books, opened tools, and special orders are non-returnable.  All returns made after 30 days of the order will be subject to a 15% restocking fee.

All Clearance and discontinued item sales are FINAL and not eligible for return or refund unless defective.

To avoid returns, feel free to request a free sample by sending an email. Please be specific as to which color (please use color numbers) you would like the sample of and include your complete mailing address.  We reserve the right to limit the number of samples.  Aureo and Orsoni Gold not included.

  1. Delivery

The Merchant will deliver the ordered products to the user (buyer) within the agreed time (products in stock up to 7 working days. The Merchant’s contractual delivery partner is DHL. The Merchant reserves the right to choose another delivery service, if this will enable him to fulfill the order more efficiently.

The Merchant shall use appropriate technological and organizational means to protect the transmission and storage of personal data and payments. The merchant uses 128-bit for these purposes SSL certificate issued by an authorized organization.

The user is also responsible for security by providing security your username and password and for the appropriate software and antivirus protect your computer.

  1. Privacy Policy

Part of these General Terms and Conditions is also the Privacy Policy, which is available at link www.smaltirogaska.com/privacypolicy.

  1. Responsibility

The Merchant strives to the best of his ability to ensure timeliness and accuracy information published in its online shop, but the characteristics of the products, the delivery time or price can change so quickly that the Merchant fails to correct the published data in the online shop it in a timely manner. In such a case, the Merchant will notify the user (buyer) of the changes and allow him to withdraw from the order or change orders.

Although the Merchant strives to provide accurate photographs of products sold in online shop, all photos must be taken as symbolic. No photos provide product properties.

The Merchant from the moment the shipment is picked up by the shipping partner the Merchant does not answer for cases of physical damage, destruction or loss of the consignment, as well as not, if the contents of the consignment are missing or if the consignment shows signs of opening. In the above cases, the user (buyer) must initiate a complaint procedure with the delivery service DHL. In case of damage to the shipment, do so by bringing the shipment to the nearest DHL office in the same condition as it was received, without adding or removing anything, and fill in the complaint report.

  1. Complaints

The Merchant complies with the applicable regulations in the field of consumer protection. In case of complaints or misunderstanding you can contact us via email info@smaltirogaska.com.

For all relationships and for rights and obligations not governed by these General business conditions, the provisions of the Code of Obligations shall apply, Electronic Commerce on the Market Act, Personal Data Protection Act data and the Consumer Protection Act.   1. Changes to the General Terms and Conditions

In the event of changes in the regulations governing the operation of online shop, the Merchant may data protection and other areas related to the operation of the online shop of the Merchant, and in case of changes in its own business policy, changes and / or supplements of these General Terms and Conditions, of which it will inform users at any time via www.smaltirogaska.com. Any changes and / or amendments to the General Terms and Conditions shall apply upon the expiry of an eight-day period from the publication of the amendments and / or supplement. If a change and / or amendment of the General Terms and Conditions is necessary due to regulatory compliance, these amendments and / or additions may exceptionally enter into force validity and use in a shorter time.

By submitting changes and / or amendments to these General Terms and Conditions does not agree, must within eight days of the publication of the notice of change and / or amendment General Terms and Conditions cancel your registration, otherwise after the expiration of this period considered and contrary evidence is not admissible to the user changes and / or additions It accepts the General Terms and Conditions. Cancellation of registration is done by the user notifies the Merchant in writing with a written statement.
